    Objectives

    To establish a panel of qualified legal service providers (attorneys) to render a wide range of legal services to the Municipality on an “as-and-when-required” rotational basis over a three-year period.

    Scope of Work

    Appointed legal firms will provide services in one or more of the following legal disciplines:

     Legal Fields:

    • Conveyancing and Property Law

    • Civil and Criminal Litigation

    • Labour Law / Disciplinary Hearings

    • Corporate and Commercial Law

    • Procurement Law

    • Constitutional & Administrative Law

    • Environmental & Planning Law

    • Intellectual Property Law

    • Debt Collection / Evictions

    • Urgent Interdicts / Land Invasions

    • Dispute Resolution (Mediation / Arbitration)

     Legal Work Includes:

    • Drafting and reviewing legal documents, contracts, and opinions

    • Court appearances across all levels (Magistrate to Supreme Court)

    • Internal legal support, disciplinary hearings, and advisory services

    • Legal representation in external disputes and litigation

    • Supporting investigations and due diligence for land/property transactions

    Technical Requirements

     Practitioner Qualifications:

    • Lead Attorneys: Must be admitted legal practitioners

    • Minimum 2–10+ years of relevant experience depending on category

    • Provide CVs, certified copies of qualifications, and practice history

     Registration and Legal Compliance:

    • Valid Certificate of Good Standing with Legal Practice Council

    • Valid Fidelity Fund Certificate

    • Company registration documents (CK/CM)

    • Proof of Tax Compliance (TCS PIN or SARS letter)

    • Municipal Rates Clearance Certificate

     Experience:

    • Proven track record in relevant legal areas

    • List of at least 3–5 instructions/cases handled (per legal area)

    • Provide reference letters and performance reports if available

     Administration & Forms:

    • Complete and sign all MBD Forms (e.g., MBD 1, MBD 4, MBD 6.1, MBD 8, MBD 9)

    • Signed declarations for:

      • No conflict of interest

      • No involvement in fraud or corrupt activities

      • Willingness to be subject to vetting

    Pricing & Fees

    • Firms must submit:

      • Hourly rates for attorneys (junior/senior)

      • Fixed fees for conveyancing matters (transfers, bond registrations)

      • Disbursement rates and policies

    • Rates must be:

      • Inclusive of VAT

      • Valid for 3 years

      • Max annual escalation: 10%

    Work Allocation Process

    • Attorneys will be placed on a rotational panel, based on:

      • Legal category

      • Capacity

      • Performance

      • Urgency or specialisation (may warrant deviation from rotation)

    Joint Ventures & Consortia

    • JV/Consortium submissions allowed

    • Each party must:

      • Submit full legal, tax, and regulatory documents

      • Sign and submit MBD forms

      • Be individually compliant
